Engaging with you

All clients are issued with an engagement letter which must be signed before we can advise or undertake any work on their behalf. Each individual engagement letter will vary according to the precise instruction.  Some of the basic conditions are summarised below.  For the complete set of terms and conditions you should refer to the letter of engagement.

Gannons aim to deliver to our clients a high quality and cost-effective service which meets or exceeds expectations. In relation to engagements and services provided by Gannons we will:

  • If we involve specialists in your matter, explain the need to involve them and, where practicable, introduce you to them before they are involved;
  • Explain what we are doing on your behalf and why;
  • Clearly explain the legal and other issues raised in your matter;
  • Where appropriate, discuss with you whether the likely outcome of the matter justifies the expense and risk involved; and
  • Keep you up to date with progress on your matter.

In order to assist Gannons with the smooth running of your matter you must provide comprehensive instructions and provide any information requested promptly.

Any complaint will be dealt with promptly and comprehensively as follows. You will receive a preliminary response to your complaint within 28 days of receipt of the complaint or if this is not possible you will be provided with reasons. Gannons will work with you to reach a satisfactory conclusion. You will not be charged for the cost of complaint handling.

If you are not satisfied with the way in which we handled your complaint you may be able to make a complaint to the Legal Complaints Service (LCS) (or in future the Office for Legal Complaints) and / or apply to the court of an assessment of the bill under Part III of the Solicitors Act 1974. Fees - method of calculation

Fees are usually charged either (a) at hourly rate or (b) on a fixed fee basis.  The basis of charging will be set out in writing for you.

We do not offer a no win no fee service as this is seldomly in your best interests although it may look attractive on the surface.

Estimates

It is often difficult for us to estimate how many hours of work will be necessary to complete any engagement or services provided. Where Gannons are asked to give an estimate of the fees that may be incurred, this is only an indication and is not intended to be a fixed quotation. Gannons reserve the right to revise the estimate at any time if it becomes apparent that Gannons will have to spend more time on the matter than originally envisaged.

Electronic communication

Gannons will communicate with you by e-mail wherever possible. We cannot guarantee the confidentiality or security of e-mail communications. Gannons do not encrypt emails.

Governing law and jurisdiction

English law governs terms of engagement and any dispute arising out of the terms will be subject to the exclusive jurisdiction of the English courts.
