Compromise agreement for director departure

We dealt with the compromise agreement for a board director leaving a major multi-national and resolved his wrongful dismissal and unfair dismissal claims avoiding both High Court and employment tribunal litigation. Our advice included dealing with employment in different jurisdictions, payments due under executive share plans and forfeiture of bonus payments, posting of clients and contacts on social media including Linked In. We agreed the timing of the departure and press announcements.  We advised our client on taxation of the termination payment, enhanced pension contributions and tax relief (including relief for foreign service) and the proper use of the employer’s discretion under the share incentive scheme. Total compensation was in excess of £1 million.
